Bernards Township Municipal Court – Phil Marchetti
This matter arose out of charges in Bernards Township Municipal Court including alleged driving while intoxicated, careless driving, parking on the highway involving a disabled vehicle, and a criminal complaint alleging failure to give controlled dangerous substances to police.
The case carried substantial exposure. In addition to the DWI allegation and related traffic charges, the criminal complaint created separate risk that had to be addressed carefully as part of the overall defense strategy.
The defense also developed important factual and medical considerations, including the client’s report that fentanyl had been involved, that emergency medical personnel responded, that medical treatment was refused at the scene, and that the client had significant eye history including multiple cornea transplants, cataract-related treatment, lens implantation, and a fixed dilated pupil that does not respond normally to light.
After litigation and resolution of the matter, the criminal charge was dismissed. The client walked away with interlock only, no license suspension, no jail, and minimum fines.
Strong municipal defense work is often about reducing both the immediate penalties and the longer-term damage to a client’s life.
In a case involving both municipal and criminal exposure, that result mattered. The outcome avoided incarceration, preserved driving privileges from suspension, and eliminated the criminal complaint from the final resolution.
