Directive #01-23 matters because it makes Recovery Court rejection reasons more specific. A broad “statute” rejection is no longer enough; the reason should connect to the statute or the Recovery Court manual.
The rejection category should identify which review path applies.
No vague statute rejection
The old broad “Statute” category was eliminated.
Equity and accuracy
More specific codes help show whether the program is being applied fairly.
What Directive #01-23 Did
The directive revised the legal rejection codes used in eCourts for Recovery Court. It requires more precise reasons for rejection and distinguishes Track One statutory reasons from Track Two manual-based reasons.
Why the Rejection Reason Matters
If a client is rejected, the stated reason controls the next move. A defense lawyer needs to know whether the issue is a prior violent conviction, danger to the community, a firearm issue, a present offense not related to substance use, immigration detainer concerns, or another recognized category.
Defense Use
The directive gives defense counsel a cleaner way to test the rejection. If the reason does not match the statute or manual, or if the facts do not support the selected code, that can become part of the argument for reconsideration or a better record.
