The purpose of this memorandum of retainer is to confirm our understanding whereby you have retained the services of John Moldovan, Esq., and The Law Offices of John Moldovan, Esq., LLC to represent you in the traffic, DWI, license, suspension, or municipal-court matter identified below.
Unless specifically noted herein, this retainer shall not obligate the firm to prosecute or defend any litigation whatsoever other than the immediate matter accepted by the firm. In the event additional litigation, motion practice, trial work, post-judgment work, or other special assignments are required, the firm may require a separate retainer agreement or supplemental written agreement.
This is a flat rate fee based retainer agreement. The fees are flat and there shall be no hourly rate billing, invoices, or otherwise unless agreed upon in writing and made part of this agreement as a supplement or rider.
This flat rate fee covers pretrial services rendered to the point of motion practice, ordinary municipal-court negotiations, license-related review and related court work that the firm agrees to handle within the accepted scope. These fees are separate and apart from trial fees, extraordinary motion fees, appeals, and other special assignments related to representation.
Any and all reasonable disbursements necessarily incurred by the firm on your behalf shall be in addition to attorney fees and paid by you. Such disbursements include, but are not limited to, court costs, sheriff’s fees, research fees, appraisal fees, recording fees, photocopy charges, fax charges, delivery service fees, experts, investigators, transcripts, and similar out-of-pocket costs.
You agree to provide the firm with the retainer payment stated in the form below on or before the time the firm begins working on the case. The firm may deposit retainer monies in its business account and apply them toward legal fees during the course of representation.
Your retainer fee is non-refundable unless agreed upon before signing this agreement or otherwise agreed upon by all parties in writing. Statements will not necessarily be rendered on a monthly basis, and failure to render monthly statements shall not constitute a breach of this agreement. You may request a current invoice from the firm at any time.
Payment in full is due within fifteen (15) days of any statement date unless otherwise agreed. Any balance not paid when due may accrue interest and administrative charges as stated in the firm’s retainer terms. In the event of default, the client consents to the imposition of any attorney’s lien or collection remedies available under New Jersey law for unpaid amounts due.
There have been no representations or guarantees made by the firm regarding the outcome of this matter, including any judgment, favorable order, diversionary result, dismissal, plea result, sentence, or other desired outcome. It shall be the duty of the firm to exert its best efforts on your behalf in the course of representation. It shall be your duty to cooperate with the firm as fully as possible so that the firm may best represent you. You agree that you will not sign documents relating to your case without prior review by your attorney, will promptly furnish information and documents requested by the firm, will promptly notify the firm of any offer or proposed resolution, and will be absolutely truthful with the firm and its staff.
Substantive decisions, including whether to accept a plea offer or other resolution, will be made by you after consultation with counsel. The firm will have primary responsibility for procedural decisions affecting the case, including which attorney handles aspects of the matter and what procedural steps are taken in the ordinary course of representation.
No oral estimate of fees may be relied upon as a limitation of the obligations set forth herein. The firm assumes no responsibility for the actions or omissions of prior counsel or any other third party. The firm may destroy files, documents, records, computer contents, or other information after the passage of three (3) years from receipt of such documentation unless otherwise required by law.
If the client fails to make payment when due, fails to comply with the requirements of this agreement, or fails to cooperate in the prosecution or defense of the matter, the firm may discontinue further representation without further notice, subject only to court approval where required.
