How Prosecutors Build Drug Cases in New Jersey
Drug cases are often built out of search issues, statements, surveillance, informants, vehicles, phones, and chain-of-custody assumptions. That means they are often more attackable than they first look.
Drug prosecutions are proof-driven.
The State usually leans on the search, the recovery, the handling of the evidence, and whatever statements it says the defendant made. Each of those can become a pressure point for the defense.
The search is often where the fight starts.
Cars, homes, persons, warrants, consent, and probable-cause arguments can all determine whether the key evidence survives.
What the defense should test early
- Search legality
- Statement issues
- Lab handling and chain of custody
- Whether the State is overstating possession, intent, or distribution
The strongest criminal defense work is not reactive. It gets out in front of pressure, isolates the State’s weak points, and forces the case to breathe on defense terms.
